This Legal Notice regulates the terms of use of the Reproclinic website and the domains associated with it.

This document is intended to regulate the RULES OF USE and ensure the PROTECTION OF USERS of www.reproclinic.com, owned by Reproclinic S.L. (Reproclinic), which is headquartered in C/ del Comte d’Urgell, 46 08011 Barcelona, Spain. The terms “You” and “User” are used here to refer to all persons and/or entities that access this website for any reason.

 

Reproclinic intends, through www.reproclinic.com, to provide users a powerful information and contact tool and to showcase both its activity and any related services.

 

 

1 – GENERAL TERMS AND CONDITIONS

 

These general conditions regulate the use of the website www.reproclinic.com that Reproclinic S.L. makes available to users for free.

By browsing the www.reproclinic.com website, you become a user of said site and express your full and unreserved acceptance of each and every one of the General Conditions in the version published by Reproclinic in effect when accessing the site. Consequently, and given that these conditions may vary, you must carefully read these conditions every time you intend to use this site.

Certain services offered to users through the website may be subject to specific conditions that, depending on the case, replace, complete and/or modify these general conditions.

The use of some services will be subject to notices, regulations of use and instructions made known to the user by Reproclinic, which complement the provisions of these General Conditions; therefore, the user must also carefully read the specific conditions applicable to said service and know them before using it.

 

 

2 – PURPOSE

 

Through www.reproclinic.com, Reproclinic makes it possible for users to access and use the various services and content made available to users by Reproclinic or by third parties, as service and content providers.
Reproclinic reserves the right to unilaterally modify, at any time and without prior notice, the presentation and configuration of the page, as well as the services and the conditions required to use the various sections of the website.

 

 

3 – CONDITIONS FOR ACCESSING AND USING THE WEBSITE

 

3.1 Free access and use of the Website

The web service provided by Reproclinic is free for users and does not require the user to pre-subscribe or pre-register in what we will call the public area, meaning that area which does not require special passwords for its use.

 

 

 

3.2 User Registration

Reproclinic reserves some of the services offered through the website to registered users, who register on the website. This registration is absolutely free and shall be made using the forms provided under the principle of transparency, and explicit and verifiable consent. The user will receive a name and password that he/she agrees to keep strictly confidential, in accordance with the provisions of clauses 3.2.1 and 3.2.2 of these General Conditions.

 

3.2.1 Assignment of Login Credentials

 

Users shall choose and indicate their own Login Credentials. Users shall not choose as their username words, expressions or word combinations that are offensive, insulting, trademarked, trade names, establishment names, company names, advertising slogans, names and pseudonyms of public persons or celebrities that they are not authorized to use and, in general, are contrary to the law or to moral standards and generally accepted good practices. Login Credentials are assigned automatically and the only criterion used in this regard is that there be no login credentials already in use that are identical to those chosen by the User. If the User does not choose Login Credentials, these will be automatically assigned by Reproclinic. In this case, the user may at any time change them for any other, always in accordance with the provisions of the previous paragraph.

 

3.2.2 Use and safekeeping

The user undertakes to use the Login Credentials diligently, as well as not to make his/her Login Credentials available to third parties. The user agrees to inform Reproclinic as soon as possible of the loss or theft of the Login Credentials, as well as of any risk that a third party may have access to them.

 

 

3.3 Obligation to use the website and the services properly

 

The user agrees to use the website and the services in accordance with the law, these General Conditions, as well as with proper morals and generally accepted good customs and public order. The user undertakes to abstain from using the website and the services for purposes that are illegal, contrary to the provisions of these General Conditions, harmful to the rights and interests of third parties, or that in any way may damage, disable, overburden or degrade the website and the services or prevent other users from using or enjoying the page and the services normally.

 

 

3.4  Means for obtaining contents

 

The User shall not obtain or attempt to obtain information, messages, graphics, pictures, sound and/or image files, photographs, recordings, software and, in general, any kind of material accessible through the site or the services (hereinafter the “Content”) using means or procedures other than those that have been placed at his/her disposal for this purpose or have been specified for this purpose on the pages hosting the Content or, in general, that are normally used on the Internet for this purpose, provided they do not pose a risk of damaging or disabling the Website, the Services and/or the Content.

 

 

3.5 Proper use of the contents

 

The user agrees to use the contents in a diligent, correct and legal manner and, in particular, to refrain from:

3.6 Use of hyperlinks that allow access to other pages

 

The users and, in general, those persons who intend to establish a hyperlink between their Web page and the Website (hereinafter, the “Hyperlink”) must meet the following conditions:

 

(a) No one may, without the prior consent of Reproclinic, set up links to the www.reproclinic.com website;

 

(b) an accepted Hyperlink shall only allow access to the Web pages of the Website, but may not reproduce them in any way;

 

(c) hyperlinks shall not point to pages within the site other than the homepage, first page or index page;

 

(d) no browser or border environment may be created on the Web pages of the Website;

Setting up a Hyperlink shall in no case imply the existence of a relationship between Reproclinic and the owner of the Web page in which it is present, nor the acceptance and approval by Reproclinic of its contents or services.

 

 

4 – PERSONAL DATA

 

To use some of the services, users must first provide Reproclinic with certain personal data (hereinafter, the “Personal Data”). Reproclinic will automatically process the Personal Data for the purposes and under the conditions specified in its Data Protection Statement,  Privacy Policy.

Users accept that Reproclinic shall be exempt from liability for the incorporation of inaccurate, false, outdated or generally misleading personal data. Likewise, Reproclinic shall not be liable for the incorporation of a person’s real data by a different person not authorized to do so.

Reproclinic assumes no liability for damages of any nature that may result from the lack of availability of the site or from the fraudulent use thereof by third parties.

Reproclinic, despite controlling all its systems and contents, cannot guarantee the absence of viruses or other harmful elements in the contents included in its website, which may make changes to your computer system (software and hardware) or to the electronic documents and files stored on your computer system.

 

7.2.2 Liability and Guarantees

 

1. Reproclinic does not guarantee the legality, reliability, usefulness, truthfulness or accuracy of the services or information provided through the Website.

2. Consequently, Reproclinic does not guarantee or accept liability for:

  • the absence of errors in said contents or the correction of any errors that may occur
  • the absence of viruses and/or other harmful components on the Website or on the server hosting it
  • the invulnerability of the Website and/or the impregnability of the security measures adopted in it

8 – NO LICENSE

10 – PROCEDURE IN THE EVENT THAT ILLEGAL ACTIVITIES ARE CONDUCTED

 

If a third party believes there are facts or circumstances that indicate the illegal nature of the use of any content and/or the conduct of any activity on the Reproclinic website www.reproclinic.com or accessible through the website, and, in particular, the violation of intellectual or industrial property rights (patents, industrial models and drawings, trademarks and trade names, etc.) or other rights, he/she must send a notification to Reproclinic providing the following details:

11 – DURATION AND TERMINATION

When reasonably possible, Reproclinic shall previously report the termination or suspension of the Website Service and other associated services.

 

 

12 – APPLICABLE LAW AND JURISDICTION



These General Conditions and rules of use are governed by Spanish law. Any dispute that may arise with respect to their validity, execution, fulfillment or nullification (total or partial) shall be subject to the jurisdiction of the Courts of Barcelona. This contract constitutes the full and complete expression of the agreement between Reproclinic and the user.
